Arbitration

In the event, the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration under the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The Arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. If any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims regarding these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims resulting from these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Sweet Sweet Palm Leaf's performance of this Agreement is subject to existing laws and legal processes, and nothing contained in this Agreement is in derogation of Sweet Palm Leaf's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Sweet Palm Leaf with respect to such use. Suppose any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above. In that case, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Agreement shall continue in effect.

Unless otherwise specified herein, this Agreement constitutes the entire agreement between the user and Sweet Palm Leaf with respect to the Site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Sweet Palm Leaf with respect to the Site. It is the express wish of the parties that this Agreement and all related documents be written in English. A printed version of this Agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Shipping Policy 

USPS free shipping can take anywhere from 3 to 7 business days, depending on your location.

International shipping can take anywhere from 14 to 30 business days, depending on your location.

If you would like faster shipping, please select the appropriate shipping carrier and service at check out.

All orders placed late Friday or over the weekend do not get shipped out until Monday.

The shipping carriers go by business days and do not count weekends or the day of pickup.

WE ARE NOT RESPONSIBLE FOR LOST/ STOLEN MAIL. 

REPLACEMENTS FOR THESE SITUATIONS WILL BE ON A CASE-BY-CASE BASIS. 

Packages are mailed via USPS & a tracking number will be sent to the email address you provided us during checkout.

Tracking may take up to 24-48 hours to update the USPS website.

If your tracking says delivered, please contact USPS for more info.

If you input an incorrect address at checkout and your package has been sent out, you must contact USPS to change your address. If your parcel ends up getting sent back to us, you will be responsible for the additional shipping charges for us to resend your package.

If you have questions or concerns about delays in the shipping process, don't hesitate to get in touch with USPS and inquire once the item is in possession of the USPS.

Once orders are shipped, we cannot control the process and cannot answer questions about delays, returned, lost, or missed sent packages. Tracking updates on the USPS website can take up to 48 hours once shipped.

DOMESTIC ORDERS

We cannot guarantee there will be no delays with USPS. If your package is delayed, it is not the responsibility of King Palm, and we appreciate your patience in receiving your package.

INTERNATIONAL ORDERS

RECEIVING PARCEL: 10-30 business days (International) *NOT including delays.

Depending on your country, you may be subject to pay customs upon importing the package on top of international shipping costs.

*We cannot guarantee you will or will not be charged any customs taxes or duties. Any customs or import duties are charged once the parcel reaches its destination country. The recipient of the package must pay these charges. This applies only to international and US Orders.

Our return policy lasts 30 days after purchase. After 30 days, we cannot offer a refund or exchange. Your item must be unused and in its original packaging to be eligible for an exchange. The item's condition needs to be the same as when received.

We cannot refund any item in its original condition; this includes damaged items or missing products unless caused on our behalf.

Once your return is received and inspected, we will notify you of the approval or rejection of your refund.

If you are approved, your refund will be processed, and a credit will automatically be applied to your credit card or original payment method within seven business days.

We can only replace items if they are defective or damaged. All exchanges must be equal: there are no exchanges for different sizes and styles.
